These terms and conditions set out the rules and regulations governing the use of the B-Power website.

When you access this website, we assume that you accept these terms and conditions in their entirety. Please stop using the Pumpkart website if you do not agree with all the terms and conditions on this page.

The following terminology applies to these Terms of Use, the Privacy Statement and Disclaimer, and any or all agreements: Customer, you and your refers to you, the person who uses this website and agrees to the Company's Terms. Company, ourselves, us, us and our refer to our company. Party, parties or we means both the Customer and ourselves or either the customer or ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary for us to complete the assistance process in the most convenient way for the Client, whether through periodic formal meetings or otherwise to achieve an express goal. The customer's needs for the provision of services/products announced by the company in accordance with the current law.

Any use of the above terminology or other words in the singular, plural, capitals and/or are interchangeable and thus refer to the same thing.

We use the use of cookies. By using the B-Power website, you consent to the use of cookies in accordance with B-Power's Privacy Policy. Most of today's interactive websites use cookies that allow us to obtain user information about each visit. Some parts of our website use cookies to provide functionality and ease of use for visitors to that area. Some of our affiliates/advertising partners may also use cookies.

License and Access

The Company grants you a limited sublicense to access and use the Marketplace for your personal use, but not to download (except for page caching) or modify it or any part thereof without Company's prior written permission. Such limited sublicense does not include/permit any resale or commercial use of the Marketplace or its content; collection and use of any product catalog, description or price; Derivative use of the Marketplace or its content; upload or copy data for the benefit of another third party; or using data mining, robots or similar data collection and extraction tools.

The Market or any part of it may not be reproduced, duplicated, copied, sold, resold, visited or otherwise used for commercial purposes without the express written permission of the Company.

You may not frame or use framing techniques to enclose the trademarks, logos or other proprietary information (including images, text, page layout or graphics) of the Marketplace or the Company and/or its affiliates without the express written permission of the Company .

Company

You may not use meta description fields or other "hidden text" using the Company's name or trademarks without the Company's express written permission.

You may not attempt to hack, "my password" or otherwise gain unauthorized access to any part or function of the Marketplace or any other systems or networks connected to the Marketplace or any server, computer, network or any service provided by the Marketplace without authorization or other illegal means.

You hereby agree not to host, display, upload, modify, publish, transmit, update or share any information that:
belongs to another person to whom you have no right;
is grossly harmful, harassing, profane, defamatory, obscene, pornographic, pedophilic, defamatory, invasive of another person's privacy, hateful, or racially, ethnically objectionable, derogatory, related to or otherwise encourages money laundering or gambling;
harm minors in any way;
infringes any patent, trademark, copyright or other proprietary or intellectual property;
violates currently valid laws;
mislead or mislead the recipient about the origin of such messages, transmit any highly offensive or threatening information;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign countries or public order, or incites any willful offence, or obstructs the investigation of a crime or offends another country;
is misleading or known to be false. Any unauthorized use will automatically terminate any license or sublicense granted by Company.

Disclaimer

To the extent permitted by applicable law, we disclaim all representations, warranties and conditions relating to our website and the use of this website (including without limitation any warranty of satisfactory quality, fitness for purpose and/or reasonable care and skill required by law). Nothing in this disclaimer means:

Limit or exclude our or your liability for death or personal injury caused by our negligence.
Limit or exclude our or your liability for fraud or fraudulent misrepresentation.
Limit our or your obligations in a way that is not permitted by applicable law.
Or exclude our or your obligations that cannot be excluded under applicable law.

Limitations and exclusions of liability set forth in this section and elsewhere in this disclaimer:

1. the previous paragraph applies to them;

2. governs all liability arising from the disclaimer or the subject matter of the disclaimer, including liability arising in contract, tort (including negligence) and breach of statutory duty.

You agree and confirm

If a product is delayed or returned from a destination in your account (such as providing an incorrect name or address or other false/misleading information), you will be responsible for any additional costs incurred by the Company in re-delivery products).

Although the Company will endeavor to ensure that the Products reach you within the period specified at the time of the order, the Company makes no guarantees about delivery time, as the estimated delivery time may change without notice, and delays may occur for any reason beyond the reasonable control of the Company. In addition, you remove our liability if you request free delivery.

You agree to use the Services provided by the Company only for lawful purposes and to comply with all applicable laws and regulations when using/aliasing and dealing on the Marketplace.

You will provide true and truthful information in all cases where information is requested from you. The Company reserves the right to confirm and validate the information and other information you provide at any time.

If any information provided by you is found to be false or incorrect (in whole or in part) at any time, the Company may, at its sole discretion, refuse registration, cancel all orders and prevent you from using its Services and other related services in the future without prior notice and without any liability to you.

You use the services provided by the Company and trade at your own risk and use your best and reasonable judgment before transacting through the Marketplace.

Before placing an order, you confirm that you have read and familiarized yourself with the product description carefully and in sufficient detail. By placing an order on the Marketplace, you agree to be bound exclusively by the terms of sale contained in the product description.

Notwithstanding Company's right to cancel an order, Company may substitute any product in an order if it is unavailable or for other reasons beyond Company's control, provided that you may refuse to accept such substitute product. . In the event of such cancellations, the Company will initiate a possible refund within 72 hours of the order/product, if any.

Order limit and minimum order value

Customers can place a maximum of 4 live orders
The customer cannot place a new order if 4 of his orders are still valid
Live order means any order that is not delivered
Drop shipping orders are split into two separate orders based on merchants
Internal orders are also considered orders
Each store has its own delivery cost. Delivery charges are indicated in the application and on the online payment page
The Company may, at its sole discretion, charge a delivery fee, excess fee, convenience fee, packaging fee, etc., for delivery of Products purchased from the Marketplace. You will be notified of such charges prior to placing your order. By placing an order, you agree to pay the fees charged by the Company

Returns and Refunds

Delivered products cannot be returned unless they are damaged, faulty, out of date or incorrectly delivered and you are requested to read the returns policy for each product listed on the Pumpkart platform before requesting a return or refund.

All refunds for returns and cancellations will be processed within seven (7) days of the date the product was returned with a satisfactory inspection, and refunds will be processed in the same manner as received, unless you have been credited with a refund, the refund will appear in your account according to the policies of the respective banks.

Promotional codes will be returned for merchandise purchased for merchandise that will expire thirty (30) days after the date of issuance of such promotional codes.

Users can also accept a discount code to receive credit for online payments. Once the offer code is activated, the refund cannot be transferred to any other payment method. All other promotional codes issued by the Company to customers will expire within seven (7) days from the date of issue. Unless otherwise stipulated and/or agreed between the Company and the Customer, payments made electronically, such as debit card, credit card, online banking, wallet, etc., will be returned using the same payment method.

All refunds will be made in Indian Rupees only.

Special conditions for purchasing cigarettes and other tobacco/tobacco products. The user agrees and obliges that:

He is at least eighteen (18) years of age or older and
He lives one hundred (100) meters from the educational institution.
The user is not allowed to use the Marketplace to buy cigarettes and other tobacco products if he is less than 18 years of age and lives within one hundred (100) yards of an educational institution.
When ordering Cigarettes and other tobacco/tobacco products/tobacco products at the store, the user must present a copy of the national identity card containing a photo and date of birth.
The user is not allowed to order loose cigarettes.
When delivering cigarettes and/or other tobacco/tobacco products, the supplier may ask the user to present an official ID.
